Which still isn't illegal per se. The government, specifically the president, is allowed to snoop without a warrant if the snoop is for foreign intelligence. See Aldrich Ames.
And even if the snoop is illegal, the remedy is a civil claim.
So, from a "in real legal jeopardy" point of view, the snoop probably doesn't end in liability to Obama.
In stark contrast, the political jeopardy against Obama and the DEMs is immense. I love it.
Adding to my previous, you will see this play out by the DEMs arguing for warrantless snooping, on the basis that anything not criminal is justified. Watch for the argument be framed (by the press) in terms of legality.
