If that was the decision of the Texas Supreme Court...fine. The Federal gov’t. has no Constitutional authority to overrule states on this issue...unless -of course - you start “seeing” all sorts of “implied” rights in the Amendments. But that is a slippery-slope towards judicial tyranny.

To say that sodomy is constitutionally protected diminishes the the document. The founders would laugh at such nonsense.
