To: Hugh the Scot

there’s no constitutional authority to “illegalize” a native plant by the FedGov. That’s my one and only issue with this.


Has the FedGov, in fact made marijuana illegal? I thought it was a case of not paying a Federal government tax on marijuana that is illegal. (Kind of like the Whiskey Tax). Now the FedGov refuses to issue Marijuana Tax Stamps so it is impossible to pay the tax. (I may be wrong about all of this, but this is how I remember it being explained many years ago.)

I’m not familiar with that aspect of the tax law. Do you have to have a tax stamp for geraniums?

Perhaps “consuming” the plant opens up other legal ramifications, but seriously... That isn’t part of my position.

It is a plant, native to this hemisphere, and did occur naturally across a wide area before the FedGov decided to eradicate it by burning money. Who thought this was a good idea?

As far as the effect it is purported to have on those who consume it, that might actually be a legislative issue; but we’d never attempt to stop arson by making wood illegal.

No, the “tax stamp” strategy was used back when the FedGov still tried to make a pretense of following Constitutional limits. Since 1970 they have simply outlawed it completely as a Schedule 1 narcotic, like heroin. The FDA bureaucrats claim they have authority to do this based on a simple act of Congress.
