Yes, you got it backwards. The statute specifically said a "fine". Obamacare even argued that before the USSC. Justice Roberts re-defined it as a tax which made the whole mess legal. If he had NOT done that, it would have never passed as a fine. We're all still wondering what was being held over his head to arbitrarily change the legal definition.
Don't hear much from Roberts since he knows he screwed the American populace by making us purchase a private product, by force of arms. It still makes me sick.

Could care less which it WAS, tax or fine. Fedzilla has NO authority to force any Citizen to buy a product. *NOTHING* in A1S8.
They can tax ‘til the cows come home but only for that which is authorized.
