The Trump administration is filing paper work for an en banc hearing of the Ninth Circuit Court of Appeals that initially voted unanimously to keep the temporary restraining order on the presidents executive order on immigration in place.

Re-write addresses the first, not the second. Rather, re-write cedes power from the Executive to the Judicial via setting a precedent. That's all the courts will ever need to intervene again in the future.
I don't know about you, but I damn' sure don't trust people who don't receive Intelligence briefings or understand the threats against this country with that kind of power.

The en banc court is going to uphold the first rulings, which means that it'll then go to a 8 justice Supreme Court, who will also screw it all up and thus, remove a power granted to ALL previous presidents. JUST DAMN!
I wonder if the surrender monkey cacus around here realize they are advocating allowing this Leftist court to establish a prescience here that Leftist judges can simply ignore the law and make up their own rules as they go along.

The Judge is wrong on this. That is the gutless easy out. Wht we must do is end these tyrants of the robes. They cannot be allowed to simply make up law. They MUST be held to account for their malfeasance.
Once you allow Judges to get away with this sort of complete politicization of the law, the Republic is finished.
The ninth court judge only gave a temporary restraining order to stop the EO. The three judge panel only upheld the TRO. A trial has not occurred. The trial is weeks away. Only after the trial will it go to the Supreme Court.

So....just HOW, can "we" FIGHT this? That sounds great; however, our hands are tied.
I know that; stop being obtuse. I just laid out why Trump going along with the en banc crap sandwich, is STUPID and how it shall go from here.
It's not the most aggressive yet legitimate reaction, but it does give the 9th Circuit an opportunity to save some face.
