Why does this Circus of a Court get to decide if THEY get to reconsider this? Wouldn’t it be up to the parties concerned?

I think the parties are to submit by Thursday briefs stating whether they think the court should rehear the case en banc. On Wednesday the government should tell them they need more time, just to screw with them.

In law, sua sponte (Latin: "of his, her, its or their own accord") or suo motu "on its own motion" describes an act of authority taken without formal prompting from another party. The term is usually applied to actions by a judge taken without a prior motion or request from the parties.
