She's not an illegal alien, she's a permanent resident, having legally immigrated with her family as an infant. She'll be deported to Mexico after her term though.

Also worth noting she didn't vote in November, the five illegally cast votes were in five different earlier elections. Her lawyer claims she didn't understand that she wasn't allowed to vote (he also claims she's a registered Republican)
