Appeals Court Denies Justice Department's Motion to Lift Travel Ban Restraining Order By DEAN SCHABNER DAVID CAPLAN Feb 5, 2017 The U.S. Court of Appeals for the 9th Circuit announced early Sunday morning that it has denied the Department of Justice's emergency motion -- filed late Saturday -- to issue an immediate stay on a Washington State judge's temporary restraining order of President Donald Trump's controversial travel ban.
"The court has received appellants' emergency motion (Docket Entry No. 14)," read the order from the appeals court. "Appellants' request for an immediate administrative stay pending full consideration of the emergency motion for a stay pending appeal is denied."
Lawyers from Washington State and Minnesota, who brought the challenge to court in Seattle, have until Sunday at 11:59 p.m. Pacific Time to file a response to the Department of Justice's request. The Justice Department then has until Monday 3 p.m. Pacific Time to file a reply brief.
Lawyers for the Department of Justice argued in the filing that the restraining order is "vastly overboard," and it "second-guesses" the commander in chief.

Sadly, we are at war, and on the edge of collapse world wide, we must steamroller everything, overload the courts so they cannot function, trump declares marshall law, and get this straight,, illegals booted out,,, hope they are rebuilding our military quickly..
You might want to talk to Congress about why they are moving so slowly to confirm the President's cabinet selections. Also, you might want to change the scale of your expectations. The federal bureaucracy is now so enormous that it takes as much as a year to get all political appointees in place. Last I read, there are some 4000 political appointees in an administration. There are millions of non-appointed civil service employees, plus who knows how many contractors and other hangers on.
Case in point: The attacks of September 11, 2001 occurred just over seven months after President GWB was sworn in. His FBI director, Robert Mueller, became head of the FBI on September 4, 2001, a mere week before the attacks.
People don't realize that there is no word in the dictionary to adequately describe how monstrously huge our federal government has become, and how a president's first year is largely consumed by getting all of his people in place.
Hopefully 90 percent of that blood will be liberals if bad men get through during this stay.

It’s moving slowly because the RATs are using every procedural tool they have to keep it slow. When they run out of those they refuse to show up for committee votes which says more about them than it does about Trump.
As to the rest, Trump is meeting all of my expectations so far. I expect him to continue accordingly. I concur the federal gov’t is HUGE. Trump’s said he will reduced it considerably. Based on his performance to date, I believe he will do exactly that.
It’s a damn shame when the law is decided by political ideology.
The Executive Branch has an army.
In the meantime, if there’s a terrorist attack, there will be blood on their hands.
The got a late Friday ruling from the judge to frustrate any appeals.
The appeals court in question is the Ninth Circuit left-leaning court.
A ‘rigged process’ you might say.
The Bush Republicans, the initial ruling came from a Bush appointed judge, want wide open borders.
The Establishment also wants trade and commerce and money from Muslim countries like Qatar and Saudi Arabia flowing freely into our country to prop up business and government alike.
Until the decision can be reversed, Trump should give instructions that all “refugees” be delivered to Seattle. All of them.

Congressional Republicans had better get with the program. They have one year, this year. Next year is campaign. Trump will say “give me a Congress which will support me” - and we will.

Yeah, but I don't see the Republicans using the tools at their disposal to force a speed-up of the process. As usual for them, they are entirely too deferential to Democrat shenanigans.
