Congress is also entitled to “interpret” the laws it passed and the Constitution and utilize the powers available to it. The House needs to immediately begin impeachment proceedings for these rogue, outrageous judges to send the message that they are way outside their zones of jurisdiction and authority. And the Senate needs to immediately confirm the nomination of Judge Gorsuch. Play time for these lawbreakers, lawfare warriors and their judicial aiders and abetters should be declared OVER. Maybe they might start getting the message that their lifetime appointments didn’t mean they are entirely immune to politics when they decide to usurp the functions of the Executive and Legislative branches.
I’m not crazy. I’ve practiced law for over 35 years and litigated probably 200+ cases where my clients either sought or were the target of federal court TROs or injunctions. I’ve also clerked for two federal circuit courts of appeals and know the standards applicable to TROs in a federal, constitutional context. District Judge Gorton in Boston got the analysis exactly right. The so-called Judge, Robert, wrote a laughable and incomprehensible opinion that ought to serve as the basis for commitment proceedings rather than praise from any real lawyer. Despite its liberal track record I really thought the Ninth Circuit would immediately stay Robart’s TRO. On the SCTUS. If these Judges want to run the country, they should be required to get elected first.

The directive to cut off non-immigrant visas from countries designated as state sponsors of terror is still current law on the books [8 U.S. Code § 1735]. Presidents Bush and Obama later used their discretion to waive the ban, but Trump is actually following the letter of the law — the very law sponsored and passed by Democrats — more closely than Obama did. Trump used his 212(f) authority to add immigrant visas, but that doesn’t take away the fact that every Democrat in the 2002 Senate supported the banning of non-immigrant visas.

Thus, the letter of the law already applies to three of the countries, and the spirit of the law applies to all of them. Plus, the State Department could add any new country to the list, thereby making any future suspension of visas from those specific countries covered under §1735, in addition to the broad general power (INA 212(f)) to shut off any form of immigration. Given that Trump has backed down on green card holders, his executive order on “Muslim countries” is essentially current law, albeit only guaranteed for 90 days!
Interesting that certain Middle-Eastern countries agree with the ban. They know if certain people are allowed in it's death & destruction!
The judge opens up our country to potential terrorists and others that do not have our best interests at heart. Bad people are very happy!
When a country is no longer able to say who can, and who cannot , come in & out, especially for reasons of safety &.security - big trouble!
