I don’t remember her being charged with anything (though she should be). No charges, no pardon.

I hope she gets charged after Obama leaves office. Then she will do the time like anyone else who committed the same crimes.

Nixon was pardoned without either impeachment or criminal charges. Hmm, I wonder how history will remember Hillary Milhous Clinton...

Actually, a president can issue a preemptive pardon that would cover any crimes that Clinton might have committed against the United States.

The leading Supreme Court case is Ex parte Garland (1867). Justice Stephen J. Field, writing for the Court in a 5-4 decision, held that the President's pardoning power is ''unlimited,'' and ''It extends to every offense known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment.''
