As I understand it he may not make it out of committee
I suspect Sen Rubio will try to appeal to both sides by voting to allow his nomination out of committee but then vote against his confirmation. If that is the case, he will be confirmed even if they have to wait for the new Vice President to be sworn in to break a tie vote.
