Those are all excellent legal points. If the Board rolls over for the recount in light of these facts Trump should head straight to court and force the board to rule by the letter of the law.

I think the RNC’s lack of an offensive strategy is a dangerous risk to take. They should have called their bluff and filed for a recount of states Hitlery won with a narrow margin. If the grand fix is in then he’s going to be left twisting in the winbd.
In the law there is a concept known as the nuisance lawsuit.
Many states have a loser pays exception that if the judge determines the suit was brought not to accrue a benefit for the plaintiff but to harass the defendant, the plaintiff can be penalized in forcing plaintiff to pay defendant’s legal cost of defense as well as their own. This is a case of a nuisance recount where the Green Party should be required to pay all legal costs when they lose.
