Law Professor: Trump Can't Hold Lease On His Hotel Near White House

After Donald Trump is sworn in as president on Jan. 20, he will follow a time-honored tradition and make his way from the U.S. Capitol down Pennsylvania Avenue.

Along the way, just a few blocks before he reaches the White House, he'll pass the Trump International Hotel. The 263-room luxury hotel is becoming the focus of a debate over conflict of interest between Trump and his business dealings.

Trump doesn't actually own the landmark building, which was once the headquarters of the U.S. Post Office. In 2013, he signed a 60-year lease for the building with the General Services Administration, which helps manage and support federal agencies. The Trump Organization spent upwards of $200 million on renovations and reopened it as a hotel about a month before the Nov. 8 presidential election.

But there's a hitch, according to Steven Schooner, a government procurement expert who is also a law professor at the George Washington University School of Law. Schooner has studied the 100-plus-page contract and says there's a clause that clearly states elected officials should have no role in the lease.

"The contract between GSA and the Trump Organization specifically says that no elected official of the United States government shall be party to, share in, or benefit from the contract," he says, citing clause 37.19 of the contract.

Schooner says the GSA should terminate the lease before Trump becomes president.

Well, he’s actually effin wrong.

The exclusions are the President and V.P.

Besides, if he steps down from Trump Enterprises the point becomes moot.

I am sure that they can’t cancel, but if they wish to pursue it, they can give back the $200 million in improvements. However Trump is sure to be able to demonstrate that the hotel will not break even until after he has left office. So he will not benefit from the space until after he has left office. This is ridiculous. Trump could also attack the contract on constitutional grounds.

NPR can wet their panties over a spurious issue such as Trump’s hotel, but never opened their pie holes when Bill Clinton was molesting an intern in the Oval Office. That’s why we hate Liberals.

Absolutely correct. My first post on this thread did not reference the section mentioned in the original post. The section mentioned in the original post is here:

Section 37.19, Interested Parties.

The lease is between the GSA and Trump Old Post Office LLC. Trump Old Post Office LLC is not a publicly held corporation or other (publicly held) entity. So, at first glance, section 37.19 would appear to mean that Trump (the person) cannot have any share of part of the lease or benefit that may arise therefrom once he becomes an elected official.

I don’t know how Trump (the person) is going to get around this, but one way might be to divest his shares of Trump Old Post Office LLC before he becomes an elected official. He’s certainly got plenty of time to do that.

I saw the source of this article was NPR.

Well, Trump may be holding NPR’s the “lease” that enables it to operate. To wit, he needs to lead the effort to defund them. No more subsidies; make the rick liberals pay for the programming they want.

Two different entities, the actual entity lessee (Trump Organization) and Donald J. Trump the individual as POTUS elect! Geez, can’t the media do better than that! Business 101.

Trump is 70. There must also be a clause to transfer his interest to his kids, his grandkids, or a purchaser.

Trump does not personally own or in this case is a personal party to the lease. He owns shares in something that does.

But it’s such a big deal? Nope.

This is not the constitution. This is the words on the lease.

However, it is unclear that since he was elected after the lease was signed that he is totally obligated to end the lease.
