Realistically, I’m not sure it’s wise for SCOTUS to touch it until Trump’s second term when we’ve maximized the number of judges that he can replace since you know Ginsburg and Breyer will be holding on until death.
I do worry that reversing that or Roe would cause a cataclysmic upheaval and risk our majorities a la Obamacare when we’re winning on the other issues. But, we do need to reestablish the idea of self-governance. I just don’t trust the electorate to act rationally in the wake of such a decision. Otherwise, I’d like for a lib to tell me when we should invade Australia to liberate their gays from their oppressive marriage inequality laws.
If Roe and Obergefell were overturned, responsibility for social policy would return to the states.
Each state should be able to decide what social policies are in their interests, not liberal federal judges.
In the long run, it will ease a great deal of the strife engulfing and dividing the country.
