There's enough evidence to indict Clinton and her entire staff for a misdemeanor charge:
18 U.S. Code § 1924 - Unauthorized removal and retention of classified documents or material
This is what Petraeus pled to, after being threatened with a more serious felony charge. It's apparently a pretty common plea deal, because the government doesn't have to expose classified information in a public trial.
If the FBI were to make this recommendation, it would put the onus on the Dept. of Just Us to charge Clinton and cronies with it. They would be unlikely to do so, but making that recommendation would probably sink Clinton, once and for all.
Either Huma or Weiner is the scapegoat. Not going to be both. My money's on Weiner's going to be charged with stealing the emails (for blackmail purposes -- get Clinton's endorsement when she wins to help him win a Senate seat) and attempted extortion.
