Unless circumstances change yet again, the country appears headed toward a close presidential election outcome.

There is a remote but intriguing possibility that few have discussed: a 269-269 tie in the Electoral College.

Very few Americans have the slightest idea of what then would happen next. It is worth explaining, as in this strange election year, we should be prepared for just about anything.

The 12th Amendment only allows the House of Representatives to choose from “the persons having the highest numbers not exceeding three on the list of those voted for as President.”

That is the basis for the McMullin campaign in Utah. If he could win one state, he would be the third potential candidate if the House of Representatives where to choose the President.

Everyone always talks about this procedure “if there is a tie,” because no third party candidate has won any electoral votes since George Wallace in 1968. Richard Nixon had more than 270 electoral votes, so it did not go to the House that year.

The electoral vote is not official until the votes are counted by the newly sworn house membership on 3 January 2017; therefore, the vote is conducted by the new house membership. The house can only consider the three candidates with the greatest number of electoral college votes for president. The vice president is elected by the Senate from the two candidates for vice president with the greatest number of electoral college votes.

Which means if it’s a tie and the GOP loses the Senate, Kaine will be Trump’s V.P.

Talk about getting stuck with an unwanted house guest...
