Then he is not much as a man in addition to being a lousy judge.
I can't buy that anyone, reaching that position in the Judicial would be that weak; specially a man.
He would be creating a nation inimical to the health, safety and welfare of his children and their descendants (if any!)
He can't be that dumb and shortsighted to fail to see that!
Ambition blinds many. He knew he had a potential problem and that he could be pressured when nominated. He chose to ignore it and now we have the current situation.
