Yeah, I don’t know how something like that would even make it into evidence if it ever came to trial. I am not an attorney, but given some exposure to rules of evidence, I cannot imagine any serious attorney filing suit without getting such details straight. But this “omission” would be perfectly consistent with the official story of the event.
