has Congress declared war ?
Congress basically ceded the powers of war (unconstitutionally) to the president after 9/11. In theory Congress must declare war except in limited circumstances.
With ISIS, since we are still “at war” based on the Gulf War 2 in Iraq, and we are still fighting ISIS in Iraq, I think the case can be made that we are at war with them.
We must have a Congress that will do its job in order to restore law and order in the land, though.
But whether we are at war or not, ISIS is a terrorist organization. Is it ok to be giving them money?
