I’m pretty sure the Supreme Court ruled in the past that the gov’t can’t discriminate against someone based on citizenship status. ‘Equal under the law’ applies to everyone under US jurisdiction, legal or not .”

I remember something like this, but the way you are paraphrasing it seems too broad, or I hope it is. If there can be no differentiation between citizen and non citizen under the law, then there would be absolutely no point in becoming a citizen. Surely we have not reached that level of insanity.

I wish I did. I could be wrong about how the ruling is applied but I think that’s the justification I’ve seen in past discussions. Maybe one of the Legal Eagles on FR can help clarify this.
