The $400 million payment to Iran was American diplomacy at its finest

The latest victim in the presidential race’s assault on truth — to say nothing of nuance — came last week in the flurry of accusations surrounding the United States’ payment of $400 million to Iran. Donald Trump called it ransom, and Sen. Tom Cotton (R-Ark.) accused the United States of acting like a “drug cartel.”

In reality, the payment represented continued adherence to a masterful feat of American diplomacy and to the peaceful resolution of disputes under international law. Ronald Reagan understood how important it is for us to keep our promises — which is why, as president, he upheld the agreement negotiated by the Carter administration that led to the recent payment.

The payment was not a ransom but rather part of a settlement agreement that the United States reached with Iran for claims arising out of the 1979 Iranian revolution, which toppled the pro-American shah and brought the current Islamist government to power. Before the revolution, the United States had signed hundreds of contracts with Iran, then an ally, to sell it military equipment. When the hostile Islamist regime took power, the military sales relationship collapsed. That left hundreds of millions of dollars of outstanding claims between the two countries and their citizens: claims both by U.S. companies for breached contracts and expropriated properties, and Iranian demands for the delivery or return of equipment that Iran had already paid for but not received — not to mention the issue of the 52 Americans that Iran then held hostage.

The deal didn’t collapse.

The contract was voided by the revolution.

Terms and Conditions (T&Cs) of the Letter of Offer and Acceptance (LOA) make clear. . .they violate the T&Cs then the contract is void AND we keep the gear AND the bucks. It’s in the contract!!

Standard practice and done before (see Pakistan and the F-16’s they lost when they went nuclear). They violated T&Cs of the contract and therefore voided the contract and we kept the money and the jets.

Obummer and his minions are lying straight out when they say we “owe” the $400M to the Iranians.

Obummer and his minions are double-lying when they say an international court was going to rule against us. . .the T&Cs make clear that no third-party has any jurisdiction in any Foreign Military Sales (FMS) contract dispute.

Please see my Post 41.

I've been in the Foreign Military Sales (FMS) world for decades.

According to the Terms and Conditions of the contract (all FMS contracts, by the way), the US and Iran are subject to—NOT bound by—a third-party of any nature, too include an international tribunal or court. . .it's in the T&Cs, clearly.

This whole thing is a lie by the administration to hide the fact they paid ransom and broke the law doing so.

Some conservative or republican somebody must be reading this thread. . .just research the DISAMM manual and AECA laws and my Post 41 points out the reasons why the administration is not only lying, but incompetent as well.

Gawd, I am so frustrated by knowing the laws, knowing the rules, knowing the contract and no one appears to be interested in reading the contract and exposing the administration for their lying.
