I am not sure that I agree with Gingrich’s solution, but he has an underlying point. If we officially recognize that we are ar war with radical Islam, we can do things that we otherwise could not do under our constitution.

If we have a formal declaration of war, then the law against treason comes into play; “aiding and abetting the enemy in time of war”.
And there are many in this government (and nation) that would be up on charges.
