That is true, but the article is not really about the guilt or innocence of the man shot, but the state of mind of the cop. Because of the passenger's video comments, people think he was pulled over by the police for a broken tail light and then quickly shot, without the police knowing anything except that he was black.
Now we know the cop was actually looking for suspects in an armed robbery that matched his description. This fact probably isn't enough to exonerate him, but he must have been more stressed approaching a car that he thought might have an armed robber in it than just some guy with a broken tail light.
Actually, they kept referring to him as a "person of interest."
