What Comey is laying out is the Fact that they had proof of wrong doing and law breaking but the way our laws/statutes are written in this matter, they could not expect to actually win a case against Hillary.
They could win a case like this against someone else, but not against Hillary.
He is trying to suggest that the laws need to be redone without saying that directly.

Comey actually said he doesn’t think people should be prosecuted for making mistakes. If I was in prison for leaking classified information I’d appeal on the grounds that it was a mistake and not intentional.
