Legal question: Can either Hilary, as former Sec of State and potential Commander in Chief, or Obama as Commander in Chief, be prosecuted by the military for violations of national security, dereliction of duty, desertion (going home while American forces under fire) or other charges?

Neither Hillary nor Obama are subject to the Uniform Code of Military Justice, so the answer is no. Obama is commander-in-chief, but he is not subject to the UCMJ.

No. But Obama can be impeached. As can Hillary -- if elected.
