This may be a case of simple trespassing or a cracked-out derelict going into a (unlocked?) dwelling looking to crash.

So what if it was? It's her home and he was an intruder. She was entitled to assume he was a threat to her and her kids.

Is that a justified homicide? We’ll see I guess.

What crap. This is a no-brainer.

Laws do differ from place to place. What flies in Texas won’t fly in New York, etc. Yes, there are non-SYG places. One can be morally justified all the way to jail. One has to know how to choose battles while the stars are not totally in one’s favor.

Actually, she will have to show she feared immediate harm to her children or herself. It sounds like she had a confrontation, and if the guy moved towards her or the kids, then it’s a good shoot.

Here in Virginia, if I walk into my house and find a guy there and just shoot him, I will go to prison for a very long time unless it’s obvious that I had cause to fear immediate grevious injury or death.
