A selfish game for the Democrat party, really.

If it is of the government, it should be race blind. The place for focused do-gooding is in the private square, and that is on account of God, not on account of Uncle Sugar. If private parties want to pony up for scholarships for what they have a reason to believe are neglected minorities, let them do so and God will bless.

By the way since liberals are so transfixed on outcomes, they should look at the outcomes of AA programs. If counterproductive, they should judge their tree by its fruit.

This is a victory for Democrats, but not a victory by Democrats.

This instead is a victory for and by Republicans.

Every Regent at the University of Texas was appointed by a Republican governor, and the majority opinion was penned by Anthony Kennedy who was appointed to the Court by a Republican.
