She is 100% correct, and she should sue, breach of contract is breach of contract.

Breach of contract doesn't get her $150,000. Breach of contract alone only gets her a refund. She actually has to prove damages to collect for damages. I can't hire someone to deliver donuts and then sue them for $150,000, because they delivered bagels.

How do you suppose that claim of damages is going to read?

From a legal angle: How much does the donut cost to raise/provide material sustenance to/college education etc. throughout its lifetime compared to a human being?
