So let me see if I've got this right. You're saying it's like you're going to a prison to visit someone with a day pass. With the day pass, you are there "lawfully".
Now once inside the prison, you hide and are there long after your day pass expires. You are now there "illegally".
The problem with the argument is yes, you may be granted "lawful purpose" to enter, but once you've stayed beyond that "lawful purpose", you are here both illegally and unlawfully.

Yeah. I read through the oral arguments a couple of days ago. That was a really bizarre exchange, and it went on longer than usual. Clearly more than one justice had issues with the government’s position on it, and the State of Texas had a pretty good argument against the feral government’s position.
The U.S. Code defines the term “illegal alien”, and the unlawful acts performed by them and to them (e.g. unlawful to ‘aid and abet’, like giving them a ride in a car).
Congress has power to determine immigration policy in the enumerated powers of the Constitution. Hussein Obama’s job is to enforce those policies, not make up his own.
Verrilli has a worse won-loss record than a St. Louis Browns pitcher!
