By contrast, mere lawful presence occurs when the Executive openly tolerate[s] an undocumented aliens continued presence in the United States for a fixed period (subject to revocation at the agencys discretion), notwithstanding that the alien lacks lawful status and is present in violation of the law.
So in the words of Obamas own solicitor: An undocumented alien whom the administration grants lawful presence remains present in violation of the law.

Now once inside the prison, you hide and are there long after your day pass expires. You are now there "illegally".
The problem with the argument is yes, you may be granted "lawful purpose" to enter, but once you've stayed beyond that "lawful purpose", you are here both illegally and unlawfully.
It's more pernicious than that. In Obamaland, you can tunnel under the wall into the prison, hide out for an unspecified period of time, and once discovered be declared lawful, whether or not you ever had permission to enter the prison to begin with.
Yeah. I read through the oral arguments a couple of days ago. That was a really bizarre exchange, and it went on longer than usual. Clearly more than one justice had issues with the government’s position on it, and the State of Texas had a pretty good argument against the feral government’s position.
The U.S. Code defines the term “illegal alien”, and the unlawful acts performed by them and to them (e.g. unlawful to ‘aid and abet’, like giving them a ride in a car).
Congress has power to determine immigration policy in the enumerated powers of the Constitution. Hussein Obama’s job is to enforce those policies, not make up his own.
Verrilli has a worse won-loss record than a St. Louis Browns pitcher!

You mean, like the FBI/CIA infiltrating, watching and pushing various Constitutional, let alone anti-govt, groups. The files v. MLK, Weaver and, most likely, the recent BLM. That’s just U.S. based, not the ‘we’ll back the Turds vs. XYZ’ or working against Asaad...the whole M.E. fuster cluster of the past 40+ yrs.
