There’s no basis for it in the Constitution. If a judge claims judicial privilege on the issue then congress can impeach and replace them. The GOP had had the tools to clean up Washington for a long time, but they’ve refused to use them. I don’t think that’s going to be a problem for Trump.
And how often do judges get impeached for failing to follow the Constitution ? Regardless, Trump will have a viscerally hostile Congress, and that with a “Republican” majority. Sadly, what will be needed at this point to put us back on track may require a literal Emperor for several decades.
