Let's say you "intend" to rob a bank of twenty bucks to pay a parking ticket (a misdemeanor), but the teller hands you a $million. Does that make you guilty of only a misdemeanor?

There is no question, in my mind, that Hillary set up the personal email server to avoid FOIA requests for documents. Instead, she certainly exposed top secret information to foreign enemies.

In my view, guilty of treason.

Treason would require intent. Very hard to prove here, because, is she wanted enemy to have info, why not just give it to them directly, or directly by actions of 3d party?
