Yes there is. When the Cruz family returned to the United States, they remained continuously in the United States for 42 years.
If they did not apply for a CRBA, Ted Cruz could only have received a 6 month visa and would have had to leave after 6 months.

There is no evidence that Ted Cruz’s family DID NOT apply for a Consular Report of Birth Abroad.
So you are just making things up.

CRBAs are not required but only recommended. He could still get a US passport which is proof of citizenship, without a CRBA.
He would have to submit his Canadian BC, his parents’ marriage certificate, his mother’s BC and a statement showing she met the residence requirement of the 1952 Nationality and Immigration Act to get a passport.
