The Cruz birth records are not sealed. Senator Cruz’s records have the same privacy rights as that of any other citizen.

Only a judge can seal a record and any record that is sealed can be unsealed by court order. A judge can also take a look at any record in chambers without releasing the data publicly.

Records maintained by the federal government that pertain to Senator Cruz can be released under a Freedom of Information Act request.
Also congressional subpoenas have the same force of law as a judge’s court order. A committee of Congress could take a look at Senator Cruz’s records if they were so inclined. They aren’t.

All true.

That assumes they still exist.

What records do you have from when you were 4 years old?

Certain key records, like a birth certificate are preserved.

But before the age of computers, many documents may have been destroyed long ago.
