You conveniently forgot that the 1790 Naturalization Act was completely rescinded, and any mention, ever, by Congress, of natural born citizens was replaced by “citizens”.

If Congress had the authority to interpret the Constitution we wouldn’t need a supreme court. If one is a citizen, not natural born, then one is a naturalized citizen, like Cruz, Obama, Rubio, Jindal, Haley, Schwarzenegger, Albright, Brezinski, Chester Arthur, Chief Justice Charles Evans Hughes, and lots of people who didn’t run, or weren’t considered for candidacy as president.

If Cruz is a naturalized citizen, so is the King of Jordan, whose mother was a U.S. citizen, a truth which probably doesn’t bother Heidi Cruz, on the executive board of the Council on Foreign Relations. Or perhaps we, by the example of the European Union would be better off as members of a North American Union with Canada and Mexico?

Thanks to FR Spaulding, again.

Are you purposely ignoring that the act you are basing your statements on was repealed and cannot be used for any legal reasoning? In fact the way the Act was repealed not only negated your interpretation but proved the opposite.

US Code Title 8 Section 1401 subsection G does not require Sen Cruz’s father to be a US citizen. His citizenship flows from his mother.

It was a given at the time that the wife of a US citizen would be a US citizen also. Wives derived their citizenship from that of their husbands.

I’ve been willing to accept that the Founders did not mean to completely rule out those born abroad, since many of them did play a part in the passage of that Act. But, many of them also played a part in rescinding it.

The problem was birth in another nation that claims jurisdiction over all who are born there in the form of citizenship, imho. Birth in another nation that required a child to be born to citizens in order to be a citizen also would not pose such a problem.

The founders said otherwise. Common law at the time required the father to be a citizen.

Why wait? Waiting gives him more time, more votes and more delegates. Do it now. Should have stopped him the minute he announced.

No one is saying his is not a citizen, he is not a natural born cotizen eligible to hold the highest office in the land.

I will ask again, do any of us truly believe the founders would consider the love child of King George and an American woman natural born eligible for the presidency? Of course not.

Ahhh, so you seem to think that you know what the founders MEANT to say and favor that over what they actually did. Well when in comes to interpreting the founders, I’ll take what they actually passed into law as a very clear demonstration of their intent.

That act was repealing in 1795 because the Natural Citizen reference was improperly worded and gave a right that the Founders did not mean to grant. The 1795 Act which replaced it does not give natural citizenship to children born abroad to American citizens.
as previosly posted (sunrise_sunset)

1790 Naturalization Act:

“..And the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens...”

1795 Naturalization Act:

“...the children of citizens of the United States, born out of the limits and jurisdiction of the United States, shall be considered as citizens of the United States...”

Yes, I was there...reading, fairly aware of the major details.

I was always amazed at the viceral and condescending pushback from some freepers, wondering what their game was, paid operatives, Hillary or Obama supporters, morons?

All the while I was thinking some of them might be Cruz boosters.

Agreed I am discussing natural born. I also agree the founders would probably say father passes citizenship. So Cruz would be considered Cuban-Canadian in their eyes.

One thing is for sure, no way they would call him a NBC

Sorry, your attempt to make a comparison by using the King of Jordan (or Churchill) FAILS as both lost their citizenship when they joined as an officer of a foreign military per USC Title 8 Section 1481.

Well, y’all have fun putting your chips on this. It will get as far as Obama’s citizenship issue did.
