You have a perfect example of why colleges should not be in the business of writing “speech codes” in the first place.
A. They always, always, always end up botching the job.
B. The first amendment will do quite nicely.
It is a huge mistake, in my view, to ever back a college campus speech code that seeks to ban speech protected by the first amendment, even in those rare cases when it bans speech that we dislike.
Why? In the overwhelming majority of cases, if will be the speech of conservatives that will be banned. Is there any doubt about that? That is the situation in Europe now—using the term “Islamic terrorism” can get you a visit from the police. On a campus, the mere expression of disagreement with, say, the concept of same sex marriage has been deemed hate speech, and grounds for expulsion. Having an American flag sticker has been derided as “divisive”. On and on and on.
