The Supreme Court is tied at 4 and 4. If they can’t decide the ruling of the lower court prevails.

Even with 8 current members I don’t believe they have voted on that issue yet.
Granted some 9 or so of the first Presidents weren’t born on in the USA but they
were born in the British colonies which were on the soil to which became the USA.
It would be interesting to see how they would rule.
