A prosecutor has a duty to review the case and see if the elements of a crime are present, and to determine if there is enough to get a conviction. If the elements are lacking, or a conviction is in serious doubt, a prosecutor will generally not file a case. I added the disclaimer because in some cases, political and activist pressure forces a prosecutor to file charges even when it is obvious someone is not guilty.
