At best it is a 50/50 issue that has not been resolved due to hermaneutics. Meanwhile we have restrictions in bearing arms, a Marine battery engaged in conflict in an undeclared war, and no immigration enforcement to what ammounts to an invasion. All grave breeches of the Constitution.

But we continue to strain a knat when there is a camel in the mix, and we will choose a celebrity who will have ZERO allies to pass anything, rather than chose the one who knows how to systematically restore the republic. We are only talking about our survival, no biggie.
