Actually, in most cases, it does. SCOTUS has said so time & time again. The most recent time was striking down the Stolen Valor Act.

No, nobody is “backing the MSM.” What we’re supporting is a little thing called free speech. You might have heard of it. It’s in another little thing for which Trump and his people seem to have little regard — a little thing called the Constitution of the United States. You might have herd of that one too.
As biased and unfair as the mainstream media can be and usually is, unless they flat-out lie (and sometimes even then), they have every right to do what they do. And we have every right to call them out — as loudly and as often as we can.
If they libel someone,. they can be sued. Under New York Times v. Sullivan, it can be very hard to prove libel if you’re a public figure. But it can be done because it has been done.
Trump indicates he wants to use it to shut up not people who intentionally libel him, but people like Magyn Kelly who make his life difficult.
This is amazing to me. Some supporters of Cruz are okay with the establishment (Rubio) and good with a Liberal/Socialist media, the arm of the Democrat Party.
