One huge problem is tha I believe the new incoming Sinators are sworn in something like January 2nd or 3rd, 2017, while the new President is inaugurated on Jan 17. If the GOP loses the Sinate, which I expect, even if The Donald is President this will give Obamao and the new Sinate majority two weeks for SCOTUS mischief. Given their track record I have no doubt they could get the spawn of Lenin confirmed then.
If the Pubes lose both the Sinate and the Presidency, then the new Dems will probably get to fully stack the SCOTUS to be 7-2 in favor of the bad guys, with Thomas and Alito being the only Constitutionalists sitting.
