If he sues and wins, his opponents will attack him, saying he cannot argue on issues, he just finds ways to knock out his rivals, like Obama did when he ran in the state of Illinois.
If he looses, it shows he is not a legal expert, and that favors Cruz, and puts doubts in the minds of people who would vote for Trump, especially with the passing of Scalia.
No, he will just keep it out there, saying it but doing nothing, because that benefits him the most.
Keep the seed of doubt in the voters minds, without proving/disproving a thing.
I agree with you, but the equation has changed with the Supreme Court now taking a big step to the left. Previously, I doubt he would ever have actually filed. Now with the chance of success greatly increased I am not as sure.
All Trump has to do now is sue in a place like Northern California. If the suit is not dismissed... the Ninth Circuit would hear the appeal. For those who watch their decisions the typical pattern is to have 2 judges for and 1 against directly along political lines. The Supreme Court would now most likely be deadlocked and the decision of the Appeals Court would stand.
All Donald has to do is provide enough wiggle room during the initial court battle for two liberal judges on the 9th Circuit to justify their decision to knock Cruz out of the race. This is not an opinion on the quality and merit of the legal arguments this is just how it would most likely work out.
