Yes, Obama does have the right to submit a nominee. Nobody is claiming otherwise.

And the Senate has the right to not consider or reject such a nominee.

Indeed he does, and the Senate, which must (advise and) consent to the nomination has every right to withhold its consent.

I didn’t think the state of this country could get any worse, but with the passing of Justice Scalia, the spectre of yet another radical liberal/commie SCOTUS appointment by the POS-in-Chief, and probable confirmation by the gutless GOP Senate, I have given up hope. I thought I was depressed before.

I need no more proof...JEB is a total and complete dumbsh*t. Wrong on Common Core, the Iranian deal, his brother’s willingness to do right and fight the good fight, immigration (with a wife I still don’t think speaks such gooda Anglish), global warming, now this. The statement is true on its face.
The president has that right.
The senate likewise has the right to determine the timeline on which they will consider such nominations.

Obola certainly does have that right and doing so would surely be an “act of love”.But the Senate has an equally clear right to deliberate in any way it wishes on any nominee.
