Trump threatens to sue Cruz for 'not being a natural born citizen'

Donald Trump on Friday threatened to sue Ted Cruz for "not being a natural born citizen" if the Texas senator "doesn't clean up his act" and stop running negative ads against him.

"If @TedCruz doesn't clean up his act, stop cheating, & doing negative ads, I have standing to sue him for not being a natural born citizen," he tweeted.

Trump has previously argued that if Cruz won the Republican nomination, Democrats would argue that the Canada-born Texas senator was ineligible for the presidency. Last month, Trump asked a rally if he should sue Cruz "just for fun" over the issue.

I don't think there is a constitutional argument there. The issue is fraud on the public.

Whether and when a court takes it up is up to the court. The way I see it, both the primary and general demand ballot integrity. The alternative is don't have a primary, which is how business was conducted before 1921.

Funny thing there, eh? Election commissions suddenly find themselves competent. There have been cases of underage candidates being denied ballot access.

The conservatives stayed home mantra was greatly overstated. That was not the reason we lost the Romney election.

Trump mentioned how amazed by politicians being nasty to each other during the debate and just fine during the commercial breaks. Trump has somewhat gotten over it, but I still don’t think he’s used to it.

Cruz must fight Trump, right now, for conservative South Carolina....Has to.

I believe that Trump still likes Cruz. You could see it at the last debate. Trump called him out when Ted refused to say to Trump’s face, the “temperament claims” made on the campaign trail. But rather than brutalizing Cruz when he backed down when facing Trump, Trump merely stated “that is what I want to do with foreign leaders.
Meaning foreign leaders will back down.

You can disagree with me, but I think Trump looks at Ted like a young man. (Trump is 25 years older).
When he goes after Ted, he chides him for bad behavior.

In the end...I think it will get patched up between them.

Shift the ineligible candidate's votes among the others, and see if it affects the outcome. A do-over might be avoided if those left standing reach a settlement.

If the ineligible candidate was otherwise the winner, and 2nd and 3rd are close together, I see no way to avoid a do-over, in order to pick a winner. Same sort of calculus can play down-ballot, too.

Complicating things in a primary, there is no way for a court to know the delegate margin at the nominating convention. All any court has potential control over is the delegates selected by election in that state.

I think it is a fraud against the public, but the courts have dismissed for lack of standing before.

No he does not.

Standing is the legal concept that someone HAS BEEN damaged, not that at point in the future they MIGHT BE damaged. Only the gubmit has Standing in prevention.

Trump must be hurting from Cruz’s hits. Trump if anything is the ‘Threat Master’, not so much on actually doing anything.

Besides what the hell happened to his Alabama buddies that filed the NBC suit? Guess that was just another example of the Threat Master.

The class of plaintiff easily dismissed is voters, all of whom are in the same defrauded boat, and none of which is standing at any disadvantage to the others, equally defrauded.

Candidates have a direct stake in the outcome. What if the winner is ineligible and takes the office? The loser lost all his effort and funds, on account of the government allowing a usurper to run.

Statutes that prohibit false certification don't depend on standing.

Probably true, but even DONEald knows this isn’t going anywhere. His polling must be showing that some of his lemmings have begun to open their eyes so its time to THREATEN AGAIN.

In what proportion and how do you show it's accurate? Damages have to be real, not speculative. Trump doesn't have it. Any suit would be thrown out. And I think Trump knows that, which is why he will shoot his mouth off about suing but will never actually file suit.

No proportion, hypothetically give ALL the votes to candidate B, then to candidate C, and so on. If none of those hypoithetical arrangements affect the outcome, the election was valid.

If the number of votes/delegates obtained by an ineligible candidate affects the booty due to somebody else, the only way to figure out where they belong is a do-over. The election is invalid.

The person suing doesn't have to prove they will win the do-over. All they have to prove is that the results of the contest aren't valid.

If Fiorina or Gilmore was found ineligible, no do-over. If Trump was found ineligible, do-over.
