Because it’s irrelevant. If Trump had a realistic chance of victory in such a matter, his bulldog lawyer, Michael D. Cohen, would already have filed.
Anyway, Trump said a few months ago that he’d had his lawyers look into Cruz’s eligibility, and they found Cruz was OK — fully eligible.
But now, Trump threatens to sue Cruz over the eligibility issue but ONLY if Cruz keeps running negative ads. The contradictions and hypocrisy are evident for all to see — except that when the Emperor has no clothes, his loyal followers will divert their eyes and pretend not to notice.

A citizen who is made so by an act of Congress, that is to say, by statute is NOT a “natural born citizen” though he is a citizen. A clear distinction was made by the Framers and it has stood unchanged since the Constitution was ratified.
Donald has not yet sued because he is giving Cruz a way to withdraw honorably. Cruz is cheating his supporters and lying to them to further his own interests.
But there is a limit to Trump’s patience.
Ctuz stated in a taped interview in 2011 that he was NOT eligible. What changed? The Constitution didn’t! he constitution is the Law of the Land.

I don’t think you have ever had to compose a complaint to be filed or a legal brief, based on your assertion. If you had any actual experience in these matters you would not make an assertion that a case is “irrelevant” without being able to say precisely why that would be so based on having actually read it.
If i was offered three to five times what it was worth and lifetime living in a fancy condominium, damn right i would sell it. So would anyone else with a gram of sense or two brain cells to rub together!
Under the Constitutions CONDITION, Cruz is not eligible.
