Robert Cordy, an associate justice of the Massachusetts Supreme Judicial Court since 2001, announced Wednesday he would retire in August, giving Republican Gov. Charlie Baker the opportunity to make his first nomination to the stateâs highest court.
Cordy, 66, was nominated to the seven-member high court by then-Gov. Paul Cellucci.
In 2003, Cordy was one of three justices who wrote dissenting opinions when the SJC issued a landmark ruling that made Massachusetts the first state to legalize same-sex marriage. Cordy argued that it was the state Legislature, not the judiciary, which had the authority to decide the issue.
âThis case is not about government intrusions into matters of personal liberty ⦠It is about whether the state must endorse and support their choices by changing the institution of civil marriage to make its benefits, obligations, and responsibilities applicable to them,â Cordy wrote at the time.

In addition to Cordy, Supreme Judicial Court associate justices Francis X. Spina, Margot Botsford and Geraldine Hines will be forced to step aside next year because they turn 70 and under state law must retire from the bench.
The mass exodus will open a majority of four posts on the seven-judge panel. Baker, a Republican in a predominantly Democratic state, is seen as a fiscally conservative manager who has already clashed with unions, but he is moderate to liberal on many social issues.
âIt has been made clear that they are looking at some diversity, and that obviously means people of color, women and others,â said a legal source, who asked for anonymity due to the sensitivity of the hiring process. âItâs going to be interesting who he picks.â
The application process for Cordyâs position has yet to begin, but sources say there is already a list of judges who would be viewed as solid candidates based on their background and other factors.
Among them:
⢠Amy L. Blake, an associate justice on the Appeals Court who was nominated by former Gov. Deval Patrick in 2008
⢠Latina, Bronx-born Appeals Court Justice Diana Maldonado, nominated by Patrick in 2013
⢠âAppeals Court Chief Justice Scott L. Kaftker, who was elevated to chief by Baker in his first judicial appointment last year
⢠âAppeals Court Justice Peter W. Agnes Jr., nominated by Patrick in 2011
Among the candidates from the lower courts, Superior Court Judge Kimberly S. Budd, an African-American who is the daughter of former U.S. Attorney Wayne A. Budd, could get a close look.
Kenneth V. Desmond Jr., David Lowy and Timothy Q. Feeley are also being bandied about as candidates who could leapfrog the Appeals Court and go directly to the SJC.
Boston Municipal Court Chief Justice Robert Ronquillo, a Latino judge who quickly rose through the ranks at the District Court level, could also be on the short list.
