Lavoy got out and acted erratically.
In ANY case such as this, the police will be telling you, and it is the only safe course, to get down immediately, lie flat and put your arms out to remove any chance of being viewed as a threat.
Sadly, for whatever reason, he did not do that.

With hands in air- that’s the key to this- at one point he stops when he feels he is far enough away from the vehicle and it appears he is complying- then the actions in question happen-
I can’t say for sure, but I suspect the fella that ran out in front of the vehicle, might have been the one to fire first- but I can’t know for sure- I suspect he would have had them sot adrenaline going at that point- Of course with so many police there- there was likely several orders being issued ‘hands in air’ ‘get down on the ground’ ‘walk towards us with your hands in air’ and for people who have never had to encounter such a situation before, there likely could have been confusion on his part=- along with the desire to draw fire away fro m the vehicle- Hindsight is an awful thing sometimes when it’s too late after a heated/tense incident occurs- Btu the key point in all this is when was he shot? Before or after hands dropped? We can’t really justify it if he was shot before his hands dropped
