Trump has the STANDING to file a lawsuit and he can d it.
STANDING -— the ability of a party to demonstrate to the court sufficient connection to and harm from the law or action challenged to support that party’s participation in the case.
Perhaps Trump is taking a wait and see attitude to see if Cruz is going anywhere. If he is, then he can file a lawsuit since he can demonstrate “sufficient connection to harm” in his campaign.
