This is a good article, by a respected Con law prof. Not saying we would agree with him on many things, but still, he is a serious scholar.

But I still think his very first point is important: Congress gets to judge his eligibility. Could Cruz really win in Congress? I actually think not. I think McConnell would sink him in a heartbeat.

Amar's argument is an exercise in sophistry. He exports the power of Congress to be the sole judge the qualifications of it's own members, into the proposition that Congress has the power to seat an unqualified president, and nothing can be done about it. So much for checks and balances.

Plus, see cases where candidates have been excluded from ballots on age, residency, or obviously being naturalized, having gone through a naturalization process. Amar would say that is unconstitutional, because only Congress has the power to judge the qualifications or a president.

You asked a great question: TurtleHead McConnell might not, but the rest of the Senate, I'm not so sure about.
Power is a strange thing, and once "We the People" elect TED CRUZ, those Senators, especially the ones up for re-election, might not want an anti-Cruz vote on their own record.
The DemocrTATS will vote any way they can to add fuel to the fire.
But they too are sill up for re-election.
Those Senators whose private polls show that they're going to lose anyway, might not care.
