The way I read it was if the Department of Justice won't indict following the FBI recommendations, the FBI will publicly indict. That is, throw it into the public arena.

I think people who know the FBI cannot indict, knew that's how it was being explained.

There may be another way however and it involves U.S marshals and it could get quite ugly, both politically and publicly.

And then of course as a last resort, there is always a Citizen’s Arrest...if it even exists anymore.......
